Case between Don Nelson and Cuban to go to arbitration

Don Nelson's claim of foul against Dallas Mavericks owner Mark Cuban is going to arbitration.
The two sides met unsuccessfully Monday in a mediation attempting to settle the disagreement over wages that Nelson and his attorney say were owed to the former Mavericks coach from previous ownership.
We're not sure what Cuban's legal reasons are going to be as to why he doesn't have to pay an employee wages he's already earned," said John O'Connor, Nelson's attorney. "It's clearly not going to settle and is headed to arbitration."
Asked what Cuban's basis is for fighting in court, O'Connor said: "In this instance, I can't figure out what it is."

The key to the above news blurb is the following part: "said John O'Connor, Nelson's attorney."
Everything we have heard about this disagreement is being spoon-fed to the media by O'Connor Nellie's attorney. And this is nothing more than two super-rich Mega-Millionaires (Nellie owns a huge amount of one of the islands in Hawaii) squabbling in public over money, with only one side telling their story to the press (Nellie's).
They are pretending pure ignorance of what Cuban's side of the story is, when they talk to the press.
They are even telling the press that Cuban doesn't have a side of the story, when they talk.
Of course, that's all pure BS.
Of course Cuban has a side to the story, and of course Nellie's attorney's know what Cuban's side is. There have been multiple rounds of depositions already on this matter, in which both sides have shoved a microscope up the other's butt to examine their arguments. And if Cuban had no valid argument (as Nellie's attorneys want us to believe), there would have been a "summary judgment" long ago where the courts said this is silly, just give Nellie the money. That is far from what has happened.
Through the process Nellie's attorneys keep trying to sell the story to the public. Cuban and his attorneys aren't arguing their side of the case in public. I'm not sure what to make of that, but to me it has the feel of the extortion tactic of "I'll make you look bad in public if you don't give me what I want."
Never forget that Nellie's self-admitted approach on situations that are crucial to him is, "If my lips are moving, I'm lying" (those are his actual words). So for us to learn the truth, the words from Nellie's lying lips or Cuban's silence will tell us nothing we can depend on. We'll just have to wait and see how it turns out.
