Let's say Stallworth, while drunk, swerved 45 degrees in a vain attempt to avoid this crazy median-hopper. Let's say it's been scientifically determined that the average person, while sober, could swerve no more than 45 degrees within the timeframe allowed in a comparable situation. If that's the case, why does the DUI matter in terms of the man's life? (Again, Devil's Advocate, but I'd still love an answer.)
Replace alcohol with suspended license to view the argument a different way. The whole point is neither should be driving and while driving illegally they killed someone.
