I don't know how much you guys have read about this but there's a very good chance this whole thing gets thrown out when all is said and done. The NFL clearly broke the rules of the CBA, so Article 46 won't come in the play.

Don't know about "clearly" Mr. B... but from a legal aspect (both reflected in Mr. Wallach's tweet as well as several legal wonks including a member of the local DA's office who volunteers at the local breast cancer awareness group my wife works at and who I've talked to a couple of times about this thing) there are some differences between the Brady case and Zeke's case that the PA is going to be able to present as the case works its way through the courts. The fairness argument is going to be the key argument. But Article 46 is still in play.

There's a long way to go. Let the courts do their thing.

The NFL should just stop being idiots, call up Jerry World and tell him if they agree to a two game suspension this whole thing dies. He should not get any, but NFL has to feel like they won something.

So to break it down as simply as I can:

5thCircuit has decided that Zeke filed the injunction before his legal options were exhausted. Now, all his legal options are exhausted, so he is able to file the same injunction now. And if the court's logic is consistent, it should be accepted again. Basically, the courts are following the rules and delaying the actual decision making process. Since the Cowboys are still in the hunt, would expect them to file again in TX (instead of NY), very soon.

The guy I go to for all this (@SportsLawGuy Gabe Feldman) that he can re-file in Texas

But seeing as how TX handled this case, it seems like they wanted this decision out of their state. They can always claim deference to the NY lawsuit, though filing in TX would buy Zeke some time. It might be best to go straight to NY with this one, considering he has enough legal merit to get an injunction through.
