There is a growing fear in NBA offices that Donald Sterling will file a lawsuit and begin to depose league and team personnel.

Sterling's attorneys could ask team personnel if their owner ever made remarks of a racist nature.

The NBA never attempted to oust Sterling as owner of the Clippers until his recorded racist comments surfaced, at least in part because of fears for how ligitious he has exhibited himself to be in the past.


Lol, going to be interesting. Funny how some posters(whom are sooooooo wise) thought he had 0 chance of a case, yet theirs speculation beyond this board that he's going to try to file.

You don't necessarily need a case to file :lol:

Especially when you got Sterling money. My guess, if he does file, he settles out of court with the NBA for even more money.

I'm still waiting for someone to show me what bylaw he broke. If Sterling wants to fight this he will probably win, he broke no laws and he didn't violate his contract. The NBA is using colusion in order for him to sell his property for less than market value, this violates anti-trust laws. You would think all these part-time legal experts would know that.

If he really does have Cancer and his time on earth is limited, why would he want to go out peacefully and be known as the one person who got kicked out of personal beliefs. Or, would he want to take his chances in fighting this to the end since it won't matter either way being the dude is rich beyond belief and he will get his money won't matter whichever way it goes. And, if he does win, then that will be his legacy more to him. But, if you are a competitive person, you go out fighting. I doubt he goes peacefully.

This thing is likely to go on for a long time. Anyone who thought Silver was just going to wave a magic wand and make Sterling go away was fooling themselves. The NBA was **** either way when this tape got leaked. If they do nothing, they risk losing millions in sponsors, player boycotts, respect from the public etc, but by doing this they have now entered into a legal battle with the league's longest tenured owner, who likely knows all of the NBA's dirty secrets throughout the Stern Era, and is going to expose everything in court. There must be a reason they've avoided trying to remove him all this time, and its likely because he's got some **** on them that they didn't want exposed. Get your popcorn ready :)

That article states an owner's may be terminated if the person fails or refuses "to fulfill its contractual obligations to the Association, its Members, Players, or any other third party in such a way as to affect the Association or its Members adversely."

Article 24 in the NBA's constitution also lists the authorities and duties of the commissioner. Silver is charged with "protecting the integrity of the game of professional basketball and preserving public confidence in the League," the article says.

That gives Silver broad authority. He has the right to make decisions in the best interests of the league in situations not covered by the Constitution and By-Laws, including coming down with penalties such as his lifetime ban of Sterling. Silver wouldn't have taken such a bold and unprecedented step if he and lawyers didn't believe their case against Sterling is solid.

Great article, finally some sources.

The question now be posed is did the NBA commissioner fail to make a decision in the best interest of the leauge when it came to other owners in similar situations.Which i believe is what the WT article on RealGM was stating.
