New York police are likely to wrap up this week their investigation into an a March nightclub incident in which Chicago Bears receiver Brandon Marshall is alleged to have punched a woman in the face, NFL sources told ESPN NFL Insider Adam Schefter.
Police have struggled to find evidence against Marshall, according to sources, and it's likely there will be no charges and the case will be closed.
Marshall said last week in a radio interview that he was confident he would be "cleared of any wrongdoing."
It's not the first off-field incident involving Marshall, which he said makes him even more of a target in public.
"You definitely have to let the judicial system take its course but again this also is one of those things as a result of everything I've been through in the past," Marshall said last week on "The Waddle & Silvy Show" on ESPN 1000. "When you go through things that I've been through it makes you a bigger target. Not only am I an NFL player, I'm an NFL player that has had trouble in the past. Whenever I step out the target on my back is pretty much bigger than 90 percent, 95 percent of the guys in the league because of who I am and what I've been through."
Christin Myles, 24, accused Marshall of striking her at a New York City nightclub and wants him held criminally responsible. Marshall's attorney, Harvey Steinberg, denies that Marshall or his friends were involved in a fight and contends he was trying to leave the club after a scuffle broke out and his wife was hit with a bottle.
"The situation in New York, it's unfortunate," Marshall said. "You never want to see anyone get hurt, but just the allegation of me balling my fist up and hitting a woman is just a lie. When the judicial system takes its course I'm very confident I will be cleared of any wrongdoing.
"My wife was the victim in this situation."

Gotta ask as I really want complete closure here.....so if it's not an issue for the police any more does that necessarily mean it's no longer an issue for Goodell ?
Didn't think you had to be found guilty in a court of law to be in violation of the NFL's personal conduct policy. Insert Debbie Downer pic here.
A couple of years ago he sent out a memo to all team which stated :
"The Policy makes clear that NFL and club personnel must do more than simply avoid criminal behavior. We must conduct ourselves in a way that 'is responsible, that promotes the values upon which the league is based, and is lawful.' This standard reflects the recognition that the conduct and behavior of our players and other league and team employees is critically important. Whether it involves your team or another, these incidents affect us all -- every investigation, arrest, or other allegation of improper conduct undermines the respect for our league by our fans, lessens the confidence of our business partners and threatens the continued success of our brand."
And he's pretty much judge, jury, and executioner with these rulings according to the CBA. If the implication that even an investigation or allegation makes the NFL brand look bad I don't know why he can't still pull the trigger on a suspension here. Ask the Saints how lenient Goodell is feeling these days.

Cliff Levingston is no expert, but it's tough to pin down what would necessitate a suspension. According to the accusation, Marshall choked a woman perhaps after his wife had a bottle broken over her head. But, the investigation is going no where, essentially exonerating Marshall of any wrong doing. So, assuming he didn't do anything wrong from that standpoint, all he did was be out late at night with his wife and draw attention due to being famous and also having a checkered past. It's not Brandon's fault that he was wrongfully accused of something and it's not his fault that the media was making a big deal about it.
With him, he's got a diagnosed mental disorder that explains his checkered past and has been very active in not only getting treatment but helping others like him. He's got a pretty good excuse for the stupid crap he used to do unlike guys like Ben Roethlisberger. So, if he is suspended, what's the rationale? "...you used to do stupid things and you were out late at a club having fun therefore you're suspended?"
So, Cliff Levingston is optimistic that no suspension comes of this and we do indeed end up getting away with grand larceny with the recent trade.

Accusations of sexual assault is a lot different than an unfounded confrontation between a woman/a wife/a husband, though.

From Dan Pompei's Q&A mailbag today....

I think you can stop worrying about Marshall not being available for the season opener because of a suspension. I have been told it is unlikely Marshall will face league discipline if, as expected, he is not charged with a crime. But yes, the league could punish Marshall if it saw fit. There is precedent for a player being suspended without being arrested or charged with a crime. It happened to Ben Roethlisberger, who was suspended six games (it later was reduced to four games) for violating the personal conduct policy. The policy clearly gives NFL Commissioner Roger Goodell the right to impose discipline if he believes the player has violated the policy.

Here it is:New York City police have decided not to bring charges against Chicago Bears wide receiver Brandon Marshall for an altercation outside a nightclub in March, according to Marshall's attorney, Harvey Steinberg.
"Brandon was the victim here and never did anything wrong," Steinberg said. "This confirms that."
A spokesman for the New York City Police Department says they are still investigating the complaint. Detective Brian Sessa of the NYPD said Thursday the case is still open.
Marshall was alleged to have punched a woman in the face outside Manhattan's Marquee club, but police struggled to find evidence against Marshall, according to sources.
Marshall said last week in a radio interview that he was confident he would be "cleared of any wrongdoing."
It's not the first off-field incident involving Marshall, which he said makes him even more of a target in public.

Marshall was traded by Miami to Chicago in March.

Brandon Marshall should realize that this is a great opportunity to really turn his life around in Chicago. He can clean up his image and gain a lot of respect from fans and his teammates if he continues advocating for the awareness of mental health issues in the NFL. The fact that he's open about his own experiences and wants to help others is a key factor that fits well in the Bears organization.

http://espn.go.com/video/clip?id=7946116Brandon Marshall discusses the incident in the video above. He says that surveillance cameras caught the entire incident. I wish I could have seen the look on that woman's face when Marshall's attorneys presented her lawyer with that tape

.
He discusses several other issues, as well.
