Police use pepper spray during arrest

Bears running back Cedric Benson was arrested late Saturday night near Austin, Texas, and charged with boating while intoxicated and resisting arrest, both Class B misdemeanors.

According to a sergeant from the Travis County Sheriff's office, Benson, who played at the University of Texas in Austin, was arrested by the Lower Colorado River Authority. A LCRA spokesperson said that Benson, who failed a sobriety "float test" (an abbreviated version of a field sobriety test) on the boat, argued over taking a follow-up test on land and refused to put on a life jacket. LCRA police attempted to arrest Benson at that time but he refused to cooperate and was pepper sprayed. He was booked at 11:24 p.m. Saturday and later bonded out, the sergeant said.

Not only does he get the non-convetional driving under the influence charge but he further cements the need for Forte to be the featured back. What a putz.

Boating while intoxicated? Hahahaha. What? That's (Please Use More Appropriate Word).

This seems like a really stupid arrest. Not just for the act that was committed but the overall stupidity of the law. Um, if you're now arresting people for boating while intoxicated you're gonna have to crack down on drunken weekend fishermen.

Boat is a large piece of machinery. People get killed or mangled on boats all the time- I'm sure drinking isn't exactly helpful while operating one of those things.

Someone over on another forum said this is not uncommon down in Texas and they only arrest if your BAC is well over .08. Doesn't sound good for Benson.

They are both misdemeanors, he'll be okay. Pro athletes get away with drunk driving all the time. Thankfully it wasn't a sex boat he was driving

It's not the boating thing that would hurt him the most, it's the resisting arrest and pepper spray part I would think.

Yeah, actually that's not true. A boat is a watercraft designed to float (duh) or plane on water in order to provide transport over it. There are classes of boats, it doesn't matter whether it's a skiff, a schooner, or a cruiser. Besides, Benson's boat is a 30 footer which isn't exactly the friggin Titanic (ship BTW).

Well he was drunk and getting arrested for something stupid. No worse than JamesOn Curry peeing outside and running away.

Im tired of Bensons indifference to be ing a professional football player.He shouldnt be drinking on a boat in any state at this time he should be at Halas hall crushing doubts he is the back the bears thought they drafted .

I'm cracking up at some of the comments posted on chicagosports.com:
I DON'T KNOW WHY THEY HAD TO USE PEPPER SPRAY,HE USUALLY GOES DOWN EASIER THAN THAT.

The Bears should sign a Chicago cop to put in the backfield next to Benson. May be that will get him to run!

That's the first time he's resisted someone trying to stop him all year!

What's not true? That a boat isn't a large piece of machinery or that people don't get killed or mangled all the time? If it's the former, I don't feel like arguing semantics with you, if it's the latter, well- you're just wrong. People get hurt all the time. That's why it's a law.

I don't care if he was getting arrested for having dreadlocks, if a cop is putting you under arrest, you comply. You have to be a moron not to, especially if you're someone in the public eye. What did he think he was going to do? Escape?
