Immediately, it's Toronto, but it's too early to tell for me. It'll be interesting to see what Toronto does with it's cap room this summer now. Also, Miami has almost enough for 2 max contracts now (extend wade and add another) so it'll be really intriguing how they handle 2010. On paper, Toronto wins, but ask me again in like August 2010 and I may have a different answer.

condition top 15 protected and cant be used next year + they gave us 3 mil which could easily be used to buy a pick at the same range

Miami wins, IMHO.
On the techincal side this is a good trade for both teams, but Riley's first objective is to keep Wade after 2010.... now they have the cap space they need for him and another all-star (probably Bosh ).
Also, Marion didn't fit in the team, and they've got a 1st pick.
