Would look badly all around imo. A stain on the Clippers for going after committed free agents. A stain on the Mavs, for Marc Cuban commenting on signing this guy publicly. And finally a major stain on DJ for being a fickle bitch.

Story going online now: ESPN sources say Clippers lobbying DeAndre Jordan to reverse his decision to join Dallas and stay in LA with Clips

WTF?

This can't be legal! If DeAndre changes his mind, Silver should fine him, the Clippers and have them forfeit future picks.

that won't happen but if he changes his mind it could alter everything

Imagine if Dallas offered Rolo 5 mil a year more than us? Would he back out on us?

For joking about how a thread that grew by pages every few minutes last week is now petering out slowly?

no, for having no sense of humor about me banning you for suggesting this thread get locked

plus we are using it, are we not?

No contracts are signed until tomorrow right, so he is probably still fair game.

Remember when Boozer got the Cavs to let their team option go and then he walked on them?

Oh damn. Never thought about the ripple effect it might have. Hopefully none of our guys back out.

Oral agreements can also be enforced as binding.

Oral contracts, when made correctly before witnesses, can be enforced. For example, in 1984, after Getty Oil was sold to Pennzoil in a handshake deal, which is legally binding under New York law, Texaco made a higher offer, and the company was sold to Texaco. (Even though the case was tried in Texas, New York law applied.) Pennzoil filed a lawsuit alleging tortious interference with the oral contract, which the court upheld and awarded $11.1 billion in damages, later reduced to $9.1 billion (but increased again by interest and penalties).

Cuban will be too committed to going nuclear on Silver and Ballmer for that to happen. He'll lose the ethical highground and legitimize the move if he turns around and tries to do the same.

Cuban could get Boozered.

The oral agreement here could not be enforced. The NBA relies on written agreements. However, it's a major no-no. His agent would have to take the fall.

The league will NEVER let that happen. Can you imagine the chaos is would create during free agency? That's not a precedent they want to set.

Jordan should have taken longer to decide really. I think he's going back if he's already having doubts.

Is there a particular rule or regulation you're aware of that pertains to player contracts?

This already happened before qwhen Jason Kidd committed to the Mavs but then decided to come to the Knicks. It can happen again

Does the CBA expressly disallow oral agreements?

Also, does it expressly prevent "agreements" that are made during this period from being unenforceable?

It would be a mess, but what could they do about it? Especially if Marc Cuban goes nuclear.

I don't see how Cuban can enforce it. It's unethical. But the league won't get in the way. They don't manage oral agreements.

Am I missing something?

What the league would do is punish an illicit oral agreement to do or not do something that circumvents the cap. This is not circumventing the cap. This is breaking the way teams and players do business.

Wait a second, the Mavs relied on Jordan's oral agreement to play for them and missed out on other FA opportunities as a result. Promissory estoppel.

I agree

this is an example of agents and players making deals before the moratorium is lifted and free agents are allowed to sign

the league probably can't do anything about it

the big issue would be between owners and agents

a max deal like this is a big thing and the ripple effects are potentially huge

I don't think it'll happen but it could
also I think its all BS that he's rethinking, I think its just media creating drama and hype

Return to New York Knicks
