The Los Angeles Times reported that the Suns are trying to clear salary-cap space to sign forward Lamar Odom, but the Suns still project to be over the luxury-tax threshold next season and have no plans to acquire him.

No, you can use the exception if you are under the cap and acquire a player that takes you over the cap.

i thought CBA dictated that you must have enough cap room to cover the first year of the contract you're offering
