I don't know what a victim is supposed to look like.

Those girls weren't suggesting anything sexual in their poses. Naivety, yes, and that is totally expected considering their age. Teenagers naturally idolize famous people. If anything there seems to be an obvious sign of drinking with minors.


With regards to the fake ID, I think the bartender would have better luck with that defence than someone who committed statutory rape.

That's overly simplistic. The analogy isn't so good because the bartender is subject to the duties and liabilities laid out in the bar's liquor license. Also, the bartender won't be charged under the criminal law, he'll be charged under the liquor control act, so the burden of proof is much lower.

The bartender can be liable even where he honestly believed that the person in question was over age ... all that matters is that he served a minor.

On the other hand, in the criminal law an honestly held mistake is usually a defence. Even a completely unreasonable mistake about someone's age could be a defence if the judge/jury believed that the defendant was honestly mistaken.

The judge/jury might say that the defendant should have investigated further, but on the other hand they might not. The outcome still very much depends on the circumstances of the case, the persuasiveness of the lawyers, and of course the sentiments of judge or jury.

It also really varies from jurisdiction to jurisdiction ... the law in Florida is different from the law in Canada. In some jurisdictions there is no mistake of fact available for statutory rape, but in Canada there is (which I assume we're talking about since that's where most of us are from), and I'm pretty sure there is in most American jurisdictions (the criminal law varies state by state in America).

Actually the bartender will be convicted with much greater ease, for a number of reasons ... but on the other hand, the bartender is facing a fine, not jailtime.

and other than hanging with wee little girls.
and other than hanging with incredibly fugly girls.

A few years ago the age of consent in Ontario was actually 14, I'm not even joking. Since then Ontario has raised it to 16. But every province and state has their own age of consent laws so you have to do your homework if your travelling.

I know this because I used to travel a lot in my late teens and early twenties and its good know the sex laws and marijauna laws of each state/province your in.
