I Got the TPE from ness when I traded Dirk for mostly cap space. As far as I know the nba allows a team to have a TPE even if they are under the cap?

The entire point of the TPE is so teams over the cap can make trades. If you aren't over the cap you don't get them.

However, it should also be noted that trade exceptions do not count against the luxury tax. Teams under the tax line like Oklahoma City and Golden State last season were not pushed over by having them and teams in the tax like Miami and Brooklyn did not have to pay additional tax on theirs.

Thabo Sefolosha, Jordan Hill, Adreian Payne, Luc Mbah A Moute, Mareese Speights, and JaVale McGee are all expiring veterans that are available for moderately cheap. Everyone else on the roster are still available (though if the offer is not formidable, I will happily be keeping my superstar players).

I was well over the cap before the trade and it seems to me like there have been teams slightly under the cap that held TPE's due to the fact that with the TPE they are over the cap?

Pretty sure if you go below the cap you lose all exceptions as well as cap holds but I could be wrong.
