When do the players and owners divide the escrow fund?

In July, after the league and the players association jointly look at last season's league-wide finances and decide what percentage of the fund is due to be distributed to the teams. This information is announced at the same time that the league announces next season's Salary Cap, Luxury Tax threshold, etc.

So, it’s the same day the moratorium on signing free agents is over and teams and players can begin negotiating contracts.

The reason for the moratorium is to provide the league with enough time to conduct its annual audit. The audit includes the escrow accounting, BRI determination for the just-concluded season, etc. At the end of the moratorium the audit is completed, the numbers are known & announced to the teams, and the teams can get busy.

Darius Miles earned $9 million in salary in 2008/09. The NBA has withheld in escrow approximately $180 million from NBA players paychecks. If Miles is on the Blazers salary cap, David Stern will keep the $9 million paid to Miles and give it back to NBA owners. The affect is the players pay Miles salary. If Miles is removed from the Blazers salary cap, the players will get their $9 million dollars back. The same process will happen again next year. David Stern is trying to steal $18 million from players.
