Circumventing Salary Cap?

There is a clause in the current CBA that restricts players from entering into transactions designed to circumvent the salary cap. Would this hypothetically prevent an ultra-wealthy fan who is unaffiliated with a team from paying a player a few million dollars to come to his city? Could the player be punished even if the fan is not governed by the CBA?
