If a team inserts this type of language into a pick, does it restrict them trading either pick until one is determined to be "weaker?"


For example, there's the pick MIN owes PHX:

2013 first round draft pick to Phoenix
Minnesota's own 2013 1st round pick to Phoenix (Top-13 Protected in the 2013 NBA Draft, top-13 protected in 2014, top-12 protected in 2015 and top-12 protected in the 2016 NBA Draft). However, if Minnesota is entitled to receive Memphis' own 1st round pick (top 14 protected in the 2013 Draft, top 14 protected in 2014, top 14 protected in 2015, and top 14 protected in the 2016 Draft) via Houston, then Minnesota shall convey the less favorable of the two picks to Phoenix.

This year, both GM's have said that unless MIN makes the play-offs, they can't ship the MEM pick to PHX to meet their obligation. However, is the MEM pick (currently #26) tradable now, or must we wait to see if MIN doesn't make some tremendous surge?

Yes, a pick to PHX is contingent on MIN making the playoffs, so PHX and MIN have yet to know whether any pick is going to PHX or not in 2013.

But the problem here, is that (unconnected to the iffiness of any pick going to PHX) there is also uncertainty over whether MIN gets a 2013 pick from MEM. At this point the 2013 MEM pick has three possible landing spots: it might (a) stay in MEM, (b) go to MIN, or (c) go to PHX.

While I'm sure the Wolves could somehow make a deal with a complex list of contingencies to convey a pick to another team from somewhere or other, they can't do any deal at this point with the assurance it will be the 2013 MEM pick, or even necessarily the MEM pick in any year.
