Forcing bad teams to be sold

In the next CBA I would love to see a clause put in that allowed the NBA to force the sale of a team if its current owners haven't been able to get them to win. What they could do is if a team has been in the bottom 3 of the standing for 5 years then the league could sell the team off to a prospective owner. An even more fun one would be that every 5 years the team with the lowest win % over that period would have the team forcibly sold. Maybe put in a clause that if a team has over 40% win for the period then they are safe.

I'm no labor law talking expert guy, but I don't think such a provision would fall within the scope of a collective bargaining agreement. And I'm no getting boned expert guy, but I don't think owners would agree to something with the potential for them to be getting boned.
