Disabled Player Exception

If a team is awarded an exception for a disabled player, is that player deemed out for the entire year?

It works the other way around.
1 They first determine that the player WILL be out the entire year,
2 then the team has to make application to the league, and
3 then the request may be approved for an exception that enables them some cap latitude to sign another player

in retrospect, I knew that order, poor wording on my part.

was just curious is he had to be deemed out for the entire year or if it was just a long time (say more than 90 days?).

At what point can they apply for it?

Can they do it now, before the season has even started?

Sure, if a player has been injured already and is going to miss the entire year, then submit your application and let the NBA docs verify he's out for the year. The sooner the better, so you can get a cap exception sooner to replace him sooner.

PS - If you're thinking about Bosh, it's unlikely MIA would consider using this Disabled Player Exception possibility with him.

Question was for Middleton fwiw, tho interesting case for bosh as well.

Pretty sure if he doesn't play this year they can move him off the cap, so no reason to do it tho.

If Middleton was thought to be out for the year, yes MIL could have and would have already applied for this exception.

He doesn't come off the cap. Not how it works. The team gets an exception for a portion of his salary. But Middleton hasn't been ruled out for the year, so they aren't going that direction.

Sorry, made that confusing lol

Second paragraph was referring to Bosh, not Middleton.

Question tho (about Middleton):
If doctors gave him a timetable for say the first week of April, would that mean he isn't out for the year? Obviously the bucks are going to take a wait and see approach, but if say they're like 20-32 at the break and clearly aren't going to make the playoffs. No reason to rush him back, play him at the end of the year for 5 games and risk another injury.

Sorry to ramble... TL;DR is there any leeway with the doctor's prognosis or is it totally at his/the league's discretion?

Correct. You don't get cap extras to add another player, to replace one who might be back in time to give you a playoff boost. He has to be ruled out past mid-June, per doc's best guess, and that prognosis is made by a non-NBA doctor (not by the player or his team or his team's doctor).

The online info says Middleton's expected return time is 6 months, ie March, so it's not hazy as far as what a doc would say. The only way it happens differently is if he has some sort of major setback before Jan 15 (the deadline for applying for a DPE) that indicates he won't be back until the summer.

Could the Blazers have used this with Festus Ezeli if they wanted too if before the deadline? Did they make a mistake by not doing it?

Welcome to the boards!

Assuming a doctor would have agreed that Ezeli was out until the end of the season, then the Blazers could have. I'm not certain if that would have been agreed to or not -- for a while it sounded like there was an expectation that he might make it back before the end of the season.

But even if it was approved, another important thing to remember is that while there is no harm in having an extra exception you don't plan on using, it does expire at the end of the season and if a team has no plans to add on extra salary, then it is practically useless. Since the exception wouldn't effect the cap and tax accounting of Ezeli's salary, any player added would push an expensive Portland roster over into the tax.

So, I would personally be more likely to label it a conscious choice not to pursue becoming a luxury tax team via the disabled player exception than a mistake, but if Ezeli's condition is bad enough to keep him out all season then they did pass up adding a touch of flexibility by not getting a DPE.
