NBA Jam was made and tested in Chicago. Jordan was in all those early games, and weeks before we were to ship nationwide he pulled out of all NBA licensed products due to his Nike deal.
But then... After the game became a hit, Gary Payton & Ken Griffey reached out through their agents to get a custom game with themselves included, and said MJ wanted to be included as well. So we made special eproms and gave them to the 3.

Jordan left the NBAPA back in the 90's. He claimed at the time that he didn't like how the NBA was featuring him almost exclusively in its promotional commercials. He felt it was diluting his value as a spokesperson.
Video game companies could not feature Jordan without negotiating a separate deal with him. And naturally, MJ wanted a lot of money. Still does. That's why you still don't see Jordan in any of the promotional commercials the NBA makes. They put out stuff that talks about the greats in the game, Magic and Bird and Kareem and whatever. Jordan isn't shown because they'd have to pay him extra, and he doesn't come cheap.
