Magnus did not call him a cheater, he said he thinks that he cheated more recently and more often than Hans admitted. Not wanting to play him is his own choice and not forbidden.
Nakamura to my knowledge did not say that Hans is a cheater at all. He literally just reads the news to his chat and gives his 2 cents. He said that all the data makes it very suspicious, but never that he is a cheater per se. If he sues him he has to sue Fabiano and every other chess YouTuber that talked about it as well. Hikaru just happens to be the richest one.
Chess.com on the other hand published a report with all the evidence they had and most of the time they stated that he "likely" cheated. The "likely" was there for a reason, they knew what was coming. The "likely" is there because of the lawsuit and not because they have doubts.
The craziest thing is he sues the dude from chess.com. There is plenty of evidence that he was way to easy on Hans. He gave him several opportunities to come back from being banned to be able to stream and make money, it is ridiculous really imho.

I get your point- but I disagree because we all know Magnus is accusing him of cheating.
You don’t have to “say” something explicitly to damage someone’s reputation or ability to make money.
If Hans cheated during the recent events, then he is getting what is appropriate-
So are you saying ONLY magnus is liable?
Short answer Yes-
I haven’t seen anything that Chess.com or Hikaru have said or done that approached liable.
Chess.com revealed what Hans himself revealed…that he cheated previously and they didn’t call him out for recent stuff that they were not involved in.
Hikaru was talking as a streamer- he said he suspected stuff, heard stuff but couldn’t know for sure. Hikaru is essentially giving opinions about things he isn’t connected to and he was careful not to bash Hans. IMO- plus it’s not like Hikaru and Magnus boys… I doubt there is some grand scheme to destroy Hans and Magnus enlisted Hikaru to help… remember Magnus has belittled and dismissed Hikaru their entire competitive lives… Magnus about Hikaru “he’s pretty good”. Wow…

How this damages Hans-
People are trying to get Magnus to play in their tournament- Magnus won’t play if Hans plays… Hans gets no invite if there is a chance in hell Magnus may play.
People are trying to throw a tournament and they may not invite Hans because if Hans wins the tournament will be stained.
Anyone that loses to Hans from now on is going to challenge the result… even some 1800 rank is gonna be like - “I don’t know bro… that felt like a stockfish line”.
No one is hiring Hans to commentate or cover any chess events - not right now- maybe in the future he is the Mike Tyson or A-Rod of chess - but right now he isn’t
I can think of a million other ways Hans is hurt by what Magnus did or didn’t say - It’s all liable-
Problem is MOST people deep down feel like Hans is dirty…
Hans is young tho- long time to right this ship -
But if he isn’t going to be a world champ or YouTube star - but instead gonna be a top 50 player- which is a amazing - it’s better to finish school and get a job or teach chess Vs dealing with this bs
