I forget who it was on here but they had this theory that she agreed to take part in sexual activity but only if she was drunk. Usually that's what happens when people take part in activities that they may otherwise be uncomfortable with, they get drunk so they feel like they aren't 100% in control.

If someone is a blackout drunk, doesn't that reflect on their character too?

Asking that is not meant to condone any form of coercion or imply being a drunk means you are fair game, but how many people actually get that drunk in their own home and not have some serious issues of their own to deal with?

Alcoholism does impair judgment in general. Could be a consideration if she is perceived as a substance abuser.

Maybe not the one instance by itself in this case, but the pattern of her social life and past drug and alcohol use could certainly play a part in evaluating a)her character, and b)how she handled alcohol in prior situations.

Aren't there text messages that show this girl asking Rose if he had any Extasy? Now she wants to say she was drugged but before the incident she was asking around looking for X pills. Wow some people are just crazy

i had mentioned something similar in the past, maybe others too. but, she does say that she had begun drinking before arriving at rose's house. in fact, she's pretty specific, she says she began drinking heavily on the car ride there. important note: she showed up with a girl on girl sex toy and one of her girlfriends. and her texts to rose earlier that day shed some light on her intentions for that night

Well there are levels to this. A few drinks to relax is one thing but getting drunk to do something you would normally not do or never had done is a massive leap in logic. Basically that means that any fall down drunk girl is fair game ie Stanford rapist case.

yes, she asks rose for marijuana and x, and the defense team will present those texts to the jury. the good thing for rose is that he denied her requests

Rose is such an idiot. Jesus Christ.

How are you late for your own trial? A sexual assault trial at that? Cmon man. Just an awful awful way to start things. Its a bit disrespectful in my opinion. Shows he isnt taking it seriously.

That's interesting, because what is the definition of "consent" in the law? I know there is this push by SJW out there to say that any alcohol use at all means no consent is possible. Good luck arguing that in court from either side.

Oh, and how can they talk about toxicology if there is no actual sample to test?

they're basing it off her symptoms, i guess. so she can be making chit up for all we know. like you said, there's no actual sample, and no way to actually prove anything. but the symptoms doe is claiming she was experiencing, and the texts to rose asking for sex, do disprove the use of date rape drugs, which doe is adamant were used on her.

from whitebronco
Dr. Lykissa is an expert of forensic toxicology. He will testify that, in his professional opinion: (1) Doe was not given Rohypnol (date rape drug) the night of August 26/27, 2013; (2) the symptoms [Doe] describes are of “advanced Alcoholic Intoxication with vomiting which places her blood alcohol content levels great than 0.2 g/dL”; and (3) Doe would not have been able to text Rose or go to work the next day had she been given Rohypnol.

Meanwhile Jane Doe was there ON TIME and he comes in 40 minutes into Jane Doe's testimony while shes crying.

Rose is really just shooting himself in the foot here. Right off the bat hes asking to lose this trial. Its basically he said vs she said trial. If im on the jury, Rose is already coming from behind and he better be sure he has a strong case against her.

Any chance Rose gets suspended for this? Im thinking he will if he loses the trial but im not 100% sure since this isnt a criminal trial. Collison got suspended 8 games for domestic violence. Some other NBA player received a suspension as well. But in both cases they both pleaded guilty. Rose is obviously innocent until proven guilty, but again since its a civil trial im not sure if Adam Silver will suspend him if he loses the trial.

I don't think he would be suspended based on a guilty verdict in a civil suit.

i'd honestly be surprised if this didn't go in rose's favor

in response, defense team will show that not even a few weeks later she was in vegas with friends, partying etc. This is the same friend who will be a part of rose's witness team and testify that doe straight up told her that she wasn't raped when asked.

concentrated enough to harass rose for money that same morning, for her cab fares for the night, and a sex toy. again, there's actual proof of this, the texts.

Did the accuser's lawyers present any crucial evidence that she was potentially drugged? If they can't, and just go by Rose's examination statement of "we men", they probably won't have much outside of Doe's testimony.
