You're right. It will probably be a chit show, because Trump is incapable of anything else. So November 4th to January 21st may be the low point of American history in this century. I expect nothing less from this deviant criminal. But he still will fail, because Trump fails at everything he does and the system still will not allow him to take over as a fascist ruler.

My concern is not whether he will be removed from the WH. My concern is he will know he's cooked and headed to jail and he will definitely seek to use his powers for vengeance and will try to destroy anything vaguely associated with Obama in that transition period. He is going to go on a crime spree and I'm worried about him trying to nuke somebody too. He's insane and he will have nothing left to lose so he will be an imminent threat to the planet in his last days.

Yes, it is possible, but that would probably only be in the case of court challenges working their way to SCOTUS past Jan. 20. In that case, Trump's term would expire and Pelosi would likely be escorted in as the temporal president until it gets resolved. But then the winning President & VP would take possession of the WH once the air cleared and Pelosi would step down.

There is a another context in what would be called a Contingent Election, but that is where the electoral college is in a virtual dead heat and whomever has the Senate majority could determine the outcome. That's not likely in this instance.

I haven't researched it heavily so I'm sure there is better information to be had on this question.

But the gist is likely that Trump does not get to camp out past inauguration date even if they've managed to turn the election into a legal battle.

I believe that Congressional oversight committees can file enforce it file filing Emergency Motions for Contempt, Temporary Restraining Orders, etc. Also, others with "standing" - like effected citizens - and can file lawsuits, usually those are filed by and through special interest groups.

One other thing I do not see anywhere is if the Dems get a landslide in the Senate, they could impeach Trump in both houses between January 3rd (when new Senators take their seats) and January 20th and let Pence handle the transition the last two weeks.

I don't see why Pelosi and Schumer would not quickly impeach him in early January if Trump is still trying to sabotage the transition.

Thus, even if there is still a looming SCOTUS ruling, the election results are for the presidential ticket and Pence would be the line of succession. So in this theory, Trump could be escorted out before January 20 and Pence could remain for the interim until a ruling or hand-over to Biden. It is unlikely then Trump would ever be let back in through the doors of the WH. If I'm right, then the president could be removed for other crimes by the Senate even if the election results remain contested, because one does not equal the other.

If Trump were inclined to overstay his term, the levers of power work in favor of removal. Because the president immediately and automatically loses his constitutional authority upon expiration of his term or after removal through impeachment, he would lack the power to direct the U.S. Secret Service or other federal agents to protect him. He would likewise lose his power, as the commander in chief of the armed forces, to order a military response to defend him. In fact, the newly minted president would possess those presidential powers. If necessary, the successor could direct federal agents to forcibly remove Trump from the White House. Now a private citizen, Trump would no longer be immune from criminal prosecution, and could be arrested and charged with trespassing in the White House. While even former presidents enjoy Secret Service protection, agents presumably would not follow an illegal order to protect one from removal from office.


I think my impeachment idea is going to take off in the media soon. Surprised it hasn't gotten any play yet, but it is clearly a swift and decisive way to 100% eliminate Trump's powers ahead of the inauguration date if that becomes necessary.

Just kidding, nowadays people accept the Supreme Court has the last word. Back then it wasn't universally accepted yet. But it's a great quote underlining the continuing struggle for power within the three branches of government.

At the end of the day the military is going to defend the constitution if they are called upon to do so. Trump has zero chance of staying in the WH without an electoral mandate.

That said, the armed forces should not get involved unless all other remedies have failed and other federal agencies have failed to remove Trump from the WH when he is required to leave.

It is bad for democracy when the military gets involved, but our military has sent every signal needed to understand they will not tolerate Trump usurping the peoples' will. Their oath is to the constitution, not the POTUS and senior brass are already seriously pissed at this guy.
