The issue with your post is not the suggestion in the abstract that we should use data to create laws. The issue is that your premise is to look at the data based on ONE person being excluded from the law. Are you saying that NYC and/or the Nets should create a "Kyrie Irving" exception? If there was such an exception, wouldn't other NBA players also want the exception? What about athletes in other sports? What about other people in general?

The whole point of laws and rules is that they work because they apply to everyone. If you stop enforcing the law because one person won't make a big difference, the effect will be that a whole bunch of others won't follow the law either and that will make a huge difference.

The bolded is absolutely correct. See the current situation at the border, it is caused by ignoring laws that are already on the books. I am not anti vax, recently got the j&j vaccine due to relocating and not wanting it to affect my job search. I am against the government forcing people to put something in their body. I am for people having a choice in what goes into their body. "Those who would trade liberty for security shall have neither". I'm paraphrasing but it is relevant in our times to remember the idea behind that statement. Kyrie has the right and responsibility to not take the vaccine if that is what he believes, regardless of what anyone on realgm thinks.
As for the NY law, it is most likely constitutional under the 10th amendment, but anybody who feels threatened or unduly controlled by it has the right to move to another state that they are more comfortable with the laws regarding covid or any other issue. Unfortunately for Kyrie he is under contract with an organization in NY state and also comply with team and league rules to work and collect his salary. I am not a Kyrie fan and disagree with quite a bit of what he says but I do support his right to say what he does, and I support his stance on this issue as well.
