The point is that regardless of whether Bates knew about the guns, regardless if the guns were owned by him, his friend or his friend's grandma. Bates shouldn't be hanging with people who get themselves into situations involving unregistered serial-defaced guns.
NBA teams don't need this in their lives.
This is contrast with young dumb kid legal trouble like Paolo getting caught riding shotgun while Coach K's grandson was drunk driving. I'm going to guess that Coach K's grandson doesn't own unregistered guns.

I thought his comment was sarcasm based on the "Emoni is only 18, we all make mistakes at 18" lol
Frankly he's an extremely poor physical specimen with extremely poor production right now. I can see taking a flier if you are one or the other, but he's just not very enticing even without being a bonehead. Pass, and if he breaks out, you can live with it, no one will be looking back like "damn, if only I had taken the kid with poor athletic markers, who was also a bad player, and also had a gun charge!!"

I don't understand how hes not facing the mandatory 2 year jail sentence. Ive known some people i grew up with that actually got 2 years in Wayne County jail for damn near the same thing. Nothing you can do about the sentence either with it being mandatory like that.
Sec. 227b. (1) A person who carries or has in his or her possession a firearm when he or she commits or attempts to commit a felony, except a violation of section 223, 227, 227a, or 230, is guilty of a felony and shall be punished by imprisonment for 2 years.

I don't think they can double-dip and make the gun charge the felony as well as the enhancement to the felony. At the very least it seems like you'd need a DA to want to do that, and I would hope that's not the case in this instance.

Possession of a firearm upon which the number shall have been altered, removed, or obliterated, other than an antique firearm as defined by section 231a(2)(a) or (b), shall be presumptive evidence that the possessor has altered, removed, or obliterated the same.
Reading about it, it seems Bates will likely get a misdemeanor plea and few years of probation.

See i was thinking scratching off the serial number would count as a felony then having a concealed weapon would make it a Felonious firearm charge.
But yeah if hes just getting charged with a concealed weapon and has a clean record then it will get dropped to a misdemeanor with some probation.

i think that law states that the dude has to be committing a felony while having the firearm, in this case the firearm itself is the felony. as far as I know I don't think Emoni was committing a felony outside having the unreg'd weapon on him. i think that's the difference here.

Yeah you got it right but if they were to charge him with a seperate felony of having a firearm with a scratched off serial number, then that is what could do it if they really wanted to.

as a casual observers can never measure or know if these prospects are knuckleheads or not. Unlike actual GMs and scouts who have background checks and sit down interviews we can only go by tape and measurements. Guys like Bates and DSJ will always stump many of us because of that

There's plenty of information out there if you know where to look. You can learn a lot about guys based on their social media & what people are saying about them online.

He’s pleading guilty to a misdemeanor, but yeah at least he won’t be incarcerated and can play this season.

He pleaded guilty for less charges. If he were truly innocent he would have fought the case. He took the path which benefited himself the most, which is admitting to what he did but with a reduced indictment.
