If you've been suspended twice, and you mess up again shortly afterwards, you will likely be waived. But just because you've been suspended twice doesn't necessarily mean there's no forgiveness.

I've had 2 suspensions myself, and I'm not exactly sure what my status is on that, but I think it's safe to say that I'm far less likely to get waived now than in August, which was the last month I was suspended or warned.

FWIW, mods don't have final authority on suspensions or bans, even globals; these things are put before the commissioners, who review each situation individually and often disagree with what the mods themselves requested, going for one more suspension or a shorter suspension and what-not.
If there's a situation where the mods are asking for a ban, a commish will take the time to investigate the situation fully and really, there's RARELY a situation where a poster who's getting banned should be allowed to just stick around the OTB board.
Also, Tom Chambers was not banned for differing political views; there was a LONG history of TOS offenses associated with him and he earned his ban as a result.
As in most cases, there's really no need to let a poster who's being banned retain any access to the forums, since that defeats the purpose of the ban in the first place.

I won't lie, I have to question how thoroughly the commish looks into a situation before banning someone.
The only reason I say this is because I was accidentally banned once. Apparently some part of a mix up because of my avatar..??
I don't know, but I find it hard to believe a thorough investigation could accidentally ban someone.

In those cases mods have input that maybe a ban was accidentally made - remember when a few posters thought they were posting innocuous pictures but a porn pic showed up instead? That's a case of mods brining it to the attention of the commishes. I know some posters (usually the waived ones) think all we have to do is report violations and voila, a suspension or banning occurs. Also, when a post is reported the commishes and globals see it as well as the board mods.
