Qualifying offer guaranteed?

Does a Qualifying offer have to be fully guaranteed?

What got me thinking about this is the Greg Oden situation. Could the Blazers(or trade destination) retain the right of first refusal by offering the QO, but only guaranteeing part of it? That way if he accepts it but can't play, they are not out the whole $9 million.

Qualifying offers are guaranteed at the same percentage as the final season of the preceding contract.

That means all QOs for a player coming off rookie scale will be fully guaranteed, always. And of course In Oden's case in particular.

But for that player who came into the NBA as a free agent or 2nd rounder, there could be all sorts of QO guarantee possibilities.

Right?

And a PS - since the CBA is all up for negotiation for 2011-12 and thereafter, all of this could change.

If you were Greg Oden wouldn't you sign that qualifying offer the second it was offered?

Considering his QO will be for $8,788,681, I think that it is a no brainer.

Yes. Coming off an injury that will likely take 2-3 years to actually fully heal, take the big payday for one year, as you'd likely only get a 2yr/$10 million type deal at most if you negotiated a good faith extension or hit the market (maybe 3yr/$15 million). However, I'd think after signing the QO, you could then get a 2 or 3 year deal on the market being a bit healthier and make good.

If they don't offer it,they lose the asset of his rights. Maybe not a great bargain, but I could see a rich team (portland) paying that to keep a potentially valuable asset.

Quite possibly. And the new deal(?) will change things.

But what would be the one year price of Oden? 5 million? I would be surprised if it is less for just one year, making the q/o if accepted a 3.5 million over payment. So basically your talking about spending 3.5 million to restrict his ability to walk for nothing.

I could see (under the current deal) several teams willing to offer 3 years at MLE money to Oden. And I could see Oden willing to switch cities, start over some where like Dallas instead of staying. By keeping him restricted you cut those offers off at the pass. Of course, if he is always a bust that doesn't matter, but if you think that then you should be shopping him now.
