NBA files lawsuit against NBPA

Accusing the players of failing to bargain "in good faith" and of "impermissible pressure tactics" in labor talks, the NBA has filed an unfair labor practice charge and a federal lawsuit against the NBA Players Association.

The claims were filed Tuesday.

The unfair labor practice charge was filed with the National Labor Relations Board. It accuses the players of making "unlawful" threats to break up their union and pursue an antitrust lawsuit against the NBA, a strategy used this year by NFL players to fight their lockout.

The lawsuit was filed in federal district court in New York. It asks the court to declare the NBA lockout does not break antitrust laws. The NBA also says it wants to void existing player contracts if the NBPA sheds its union status.

Isn't it more just a pre-emptive strike against the NBPA's threats to decertify?

With the NFL, the player's union decertified, then there was the Brady antitrust suit...but didn't that just get dropped once a deal was reached? IDK, I'm no attorney, but I still don't see why this necessarily means an increased likelihood of no games.

Are you saying without the ability to play the decertification card, the NBA lawsuit takes a big bargaining chip away from the players, ultimately slowing down the process?

yeah something like that...it just seems like their wasting time with lawsuits and blaming each other...stuff like this is going to stop them from having any civil negotiations...
if nba strike doesnt end by the first game of the season...i dont think we will have a season at all.

wow, Stern is 2 steps ahead of everyone right now. he probably saw this coming and already made the adjustments in favor of them.

This is turning into a political debate. Two sides that refuse to acknowledge the valid points in the other side. I can't see this lawsuit being a good thing, at all. We all know that David Stern doesn't like being made into a scapegoat or example.

This would be great if all the NBA contracts got voided and everyone would had to start over. Imagine all the superstars that will move there talents to LA. :lol:

Getting tired of reading about millionaires / billionaires disputing over money. In a perfect world, they all end up broke and become enslaved to us fans and must entertain us to keep from being launched into the Sun.

Players Association executive director Billy Hunter says the 2011-12 NBA season will likely be canceled entirely because the commissioner's negotiating leeway is in danger of being undermined by a group of hard-line owners.

"The circumstances have changed among [David Stern's] constituency," Hunter told a group of lawyers Wednesday, as quoted in the Baltimore Sun. "In the last six or seven years, there is a new group of owners to come in who paid a premium for their franchises, and what they're doing is kind of holding his feet to the fire."

Hunter told an American Bar Association conference that if he "had to bet on it", he would wager that there will be no NBA season.

"We're $800 million apart per year," Hunter said Wednesday, adding, "something has to happen that both of us can use as leverage to save face."

NBA owners and players held a formal collective bargaining session for the first high-level negotiations in a month Monday but after nearly three hours of discussions the sides emerged as far apart as they were when the day began. Stern said the sides were "at the same place" as they were when the lockout began July 1 just before the old collective bargaining agreement ran out.

Owners are seeking significant changes to the league's salary structure, claiming $300 million in losses last season and hundreds of millions more in each year of the previous agreement, which was ratified in 2005. Players have acknowledged the losses but disputed their size, and they've balked at the league's push for a hard salary cap and reduction in salaries and maximum contract lengths.

The union has encouraged players to find work rather than give in to the owners' economic demands, with the hope that owners would offer better proposals if they see their players have other options. Hunter recently sent a memo to all players endorsing locked-out players to consider playing overseas.

Nets All-Star Deron Williams agreed to an overseas deal with Besiktas of Turkey, the only superstar with an overseas deal thus far, though some lesser players have one. Many elite players say they are keeping it as an option.

Hell yeah guds....and it's going to stay that way. What the players union don't realize is that before Stern became the commish, he was the NBA's lead lawyer. The man isn't dumb by the furthest stretch. The NBA Players Association should have just dissolved their union like the NFL did and kept Stern and the owners at bay.

I believe a lot of the losses by the owners are an exaggeration. Every time the players start to get ahead there is a strike. This is another form of "control" trust me on that one.

Both sides are exaggerating right now. That's the problem... No 'good faith' yet...

Personally, I'm not paying attention any more. Call me when it's over.

I feel like they're both using us fans as leverage, and it's starting to irritate me.
