If this happened in May, why is it just coming out now? Complete moron move, and I really don't understand players that make that much money (even 800k is a lot of money), who drive wasted. Taxis aren't that expensive.

PJ goes out drinking and has his personal taxi driver on call for a ride home. I know this sounds unserious and flippant, but the cost for each player to have their own on call driver would not be prohibitive.

At the end of the day, extremely intoxicated people will usually not show the proper judgement on whether to drive home or get a ride.

i do not think the league suspends him any more than 2 games - just like Kidd and Ebanks. His was not any worse than theirs. In fact Kidd caused property damage.

Correct. Since his DUI was so high (.22) the police officer charged him for everything he could under what tucker blew. So since he blew over .20, there were multiple charges that tucker fell into. So the officer stacked the charges. Tucker was initially stopped for falling to stop at a stop sign (which almost sure the officer probably saw some erratic driving from tucker prior to the stop sign blow throw) . Once the officer suspected tucker driving under the influence and got conformation from the intoxilyzer, the officer than charged him with everything he could under Scottsdale law. All of it from one incident.

They can charge him with all 4 because of the differing burdens of proof, but he can't be punished for all 4. For instance, if he's found guilty of the > 0.20 charge, he'll be punished under that charge, and not for all of the smaller ones as well as the >0.20. It gives the prosecutor leeway so that if they can't prove his BAC was above 0.20, they can still get him for the lesser amounts. That's why they stack them. It's much easier to prove BAC > 0.08 than 0.20, and it essentially ensures he'll be found guilty of one of the degrees of DUI. I expect PJ to take a plea. He'll probably get a minor sentence relative to what most would get b/c his career is shorter than most and missing games is therefore argued as more detrimental (that's one of the reasons most athletes get suspended sentences). I am curious whether McDonough knew of this before reaching his deal. It would've hurt his value a little bit. How did this not get out until now when it happened back in May?

Actually one charge is not harder to prove than another when it comes to DUI. For his level, I guarantee blood was taken from tucker. Tucker's defense attorney will try hard to get a few of those charges thrown out.

But I digress, I'm more interested in how the suns are going to handle this.

Last week, Tucker signed a three-year, $16.5 million contract ($12.7 million guaranteed) with the Suns. The Suns were aware of the charges before signing Tucker to his deal.

Good to know that was all related to one charge. I don't think the Suns will punish him if they knew about it before signing him, unless they told him if he is convicted they will be forced to. They probably also put conditions in his contract that if anything like this happens again, the contract is voided (I don't know if that is even possible under the CBA but if it is, it seems they would do it).

Does anyone know if the CBA allows for a morals clause to be inserted into a contract? If so I can think of about a dozen players who need a new contract with a morals clause in place.
