So, the reports are that the Clippers are staying at DJ's house (which is in Houston, I've learned in this thread) until midnight.

Here's what I think happens. The clock strikes midnight and there is a knock on the door. Doc pushes a couch against the door and tell CP3 to go around and watch the back. All of the sudden the phone rings...Blake answers it and the voice on the line is whispering "He's in the house!"

They all turn around and they see Daryl Morey standing next to DJ, contract in hand with DJ wearing a Rockets shirt and hat. Outside the window they see Mark Cuban and Chandler Parsons banging on the glass screaming "nooo!!!" as DJ signs with Houston.

...who go on to set the NBA record for missed free throws in a season.

LMAO, there wouldn't even be a meeting today if Jordan hadn't called Doc on his phone and wanted to discuss it. Give me a break. Any organization in this position would hear Jordan out and then schedule a meeting if the deal hadn't actually been finalized yet. There is no contract between DJ and Dallas, currently, according to the CBA.


No one know who called who at this point. But if Fegan ends up suing the Clippers, we might actually find out when phone records are subpoenaed.


Sue for what? Hurt fee fees?

Tortious interference with a contract. If you're told that you have to communicate with the attorney/agent, you don't get talk directly to the client in order to get what you want.

Absolutely disgusting, his agent might as well walk from Jordan after they sign this deal, he has ruined his credibility in contract negotiations going forward.

Because Fegan has a contractual relationship with his client, the Clippers are supposed to communicate through him and when you go around an agent/attorney like that, you open yourself up to a tortious interference claim. If Fegan decides to leave the money on the table, and won't agree to represent DJ if he signs, he's got a claim. Whether he's ultimately successful or not remains to be seen. But if he were to get past he pleading stage, and had an opportunity to conduct discovery, he could make things awfully uncomfortable for that organization.


No real reason for Fegan to do that.

If Fegan is still kept on as DJ's agent, he gets a cut regardless of which team DJ goes to. He actually gets more with Clips, because of the extra year and bird raises.

If Fegan is fired, he still has other clients to represent. Burning bridges with the Clippers might yield short-term satisfaction (and even then he may not win a case, and would have to spend money fighting it). But it would kill his prospects with the Clippers when it comes to pitching them his other clients. And potential clients would view him as having reduced negotiating power when they sign with him if he's only able to find deals with 29 out of 30 teams instead of all 30. And any other teams or players would have to think twice before doing business with him if there's a precedent of him suing them.

So, no, whether he has grounds or not, there won't be an court case forthcoming from Fegan. Bad for future business for him.

Jordan would be dumb to return to clippers. When they first lost him, what did they do? They reached out to other centers, and now they're desperately wanting Jordan back as a last resort. They should have done more initially to get Jordan to stay and done this way before the day before the actual signing

There doesn't need to be a contract for tortious interference with business relationship. Found the elements on Westlaw and Cuban has a case.
