It's a pattern. No way Kief changes his tune. When his NBA days are done I would expect he and his brother to be in jail or worse shot. This guy needs to be gone from the team now.

No way these two take a plea bargain. I'm sure they are both in full denial mode and don't believe they have done anything wrong.

According to our only witness (roommate of a poster), Keef was in the crowd (handling the crowd) and didn't participate in the assault, like Hood says he did. I still don't see the case the prosecution has.

The motion that Coro is referring to is a motion to remand to the grand jury for a new finding of probable cause. I haven't read the motion. I've only reviewed the docket sheet, which references the motion by name. These types of motions generally allege some sort of defect in the grand jury proceedings that undermines the grand jury's basis for finding probable cause. The grand jury is responsible for determining whether the state has a sufficient evidentiary basis to proceed with charges against the defendants. If this motion were granted, it would be a major victory for the Morrii and would probably push the timeline back significantly. I believe the prosecutor would have to once again convince a grand jury that there was sufficient evidence to issue an indictment against the Morrii. It would essentially hit reset on the proceedings to date. It's understandable that the judge would want to take sufficient time to fully consider the motion.

This is a solid post. Let me try to parse through the legalese for ya'll. The Morrii are taking a risky wager that they will get their aggravated assault charges dropped entirely if they continue with the process and contest the charges of the preliminary hearing in what was known as their not guilty arraignment. They are also holding out for when a plea agreement becomes available to reduce their charge from two matching counts of Class 4 and Class 6 felonies to a simple misdemeanor. If they are convicted and sentenced in accordance to both such penalties they could presumptively face up to 2+ years of incarceration with an additional year tacked on. Right now the date of the trail is set to begin on September 30th which overlaps with the start of training camp and could drag on throughout the 15-16 NBA regular season which the Morrii would not prefer. So their defense team are waving their right to a speedy trial by petitioning for the case to be reclassified as Complex/Capital in order to postpone the trail timeline into 2016 by 270 days from the date of arraignment so that it ends sometime by mid February next year which still doesn't really work in their favor. Today's pretrial conference is where the court will review the defense attorney's motion to remand the grand jury and request extended time to a file a response since the transcripts where only procured last week. The litigant will also be questioned on the inconsistencies/changed testimonies of the witness and the motive behind not disclosing the aformentioned(The Morrii were not actually present this morning)

Here's Coro's story about the hearing this morning. Here are some interesting snippets:

The defense attorneys for Marcus and Markieff Morris have asked a Maricopa County Superior Court judge to return the case to a grand jury because they say prosecutors falsely presented information that led to an indictment on charges of aggravated assault.

Prosecutors presented "false and misleading evidence" and withheld information vital to the case, the Morris twins' attorneys said in motion to return the case to a grand jury to determine whether there is probable cause to indict the NBA players.


The defense attorneys contend in a motion filed on July 14 that prosecutors did not share the testimony of a witness who told police that he saw the Morris twins in a parking lot "at least 100 yards away from the fracas," according to the motion to remand the case to the grand jury.

Prosecutors also failed to tell the grand jury that Hood had changed his version of the story multiple times, the motion said,

The defense said that Hood's initial statement, two hours after the attack, stated that he was hit in the back of the head while attempting to leave the game. He tried to get away, but fell and he was beat by the Morris twins and three others.

In his second account, after talking with his attorney, he again said he had been hit while attempting to leave the game, according to the motion. Hood added that he took off running towards his car, but that he realized he wasn't going to make it there. He then decided to take off down the street and that no one caught up to him until he fell near the gate, the motion said.

He confirmed that version the next day, and drew his route on a map.The motion also states that not one witness is able to definitively place the twins any closer than 15 or 20 feet away from the attack.

If I am on that jury I am not going to worry much about where the twins were. Their "posse" was definitely involved and the only people there who had a beef with Hood were the twins. So either they participated or the beating was carried out on their behalf. No matter how you look at it, they are the bad guys. The only redemption might be if Marcus was involved in the beating but Markieff wasnt. Then the blame could fall wholly on Marcus.

LOL. Sounds like the twins beat the crap out of this guy and then tried to pay him to change his story, but the prosecutors wanted to still try to pin charges on them.

So much for that theory.

Most legal minds (Babby?) probably saw something like this coming or at least not surprised. This whole incident has been muddled with sketchy info, lack of or reluctant witnesses, denial, flat out lies, shady characters, including momma,.... and 5 guys fleeing in a phantom :o .

Seems like it could be drawn out for sometime. The State's case seemed flimsy from the beginning. society can be quick to judge, and things can appear quite clear... but in a court room, different deal.(see OJ) If evidence is suppressed, omitted, turned in late, monkeyed with, it can jeopardize the whole case. The letter of the law can be quite confusing to read but must be followed.

There.....my summary based on several yrs of Perry Mason, Law and Order, and multiple viewings of My Cuz Vinny 8-)

I wonder if those ILWT 'room mate' witnesses have been subpoenaed.

Regardless of personal opinions of these mini thugs (see, mine slipped in), an acquittal is the best thing for the organization.
