Only Early Bird rights, not full bird rights. So that means 175% of his current salary of $7M, which is $10.5M. Early bird rights would allow the Hornets to pay him up to $10.5M.
If his market value with the increasing cap and his current play improvement means having to pay him more than $10.5M, then the Hornets can only use free cap space to do so and not the Early Bird exception.

175% is $12.25M. However, as it stands, Bird Rights will not affect too much. We're operating under the cap this summer (assuming we don't do something r-worded with Big Al) so we can offer him as much as we have under the cap. His cap hold of $9.1 will remain if we do sign someone else and leave $9.1M left over, then we can re-sign Marvin to a contract worth up to $12.25M.
Personally, I don't want to retain Marvin on a long-term deal worth that much. The guy has improved leaps and bounds in a contract year and after the Lance Stephenson fiasco, I'm understandably nervous about a guy who has had exactly one good season in the last several years. I'd be willing to pay huge for another one-year deal, or maybe even a 2 year deal, but after that, we're talking about a guy with a mediocre (and trending downwards prior to 2015-16) track record with a major injury and a lot of miles on his body (despite only being 29). I'd be terrified to throw him MKG money for 3-4 years.
