US Justice Department: HB2 violates federal Civil Rights Act

U.S. Justice Department officials rebuked North Carolina’s House Bill 2 on Wednesday, telling Gov. Pat McCrory that the law violates the U.S. Civil Rights Act and suggesting that it could jeopardize the state’s federal education funding.

The department gave state officials until Monday to address the situation “by confirming that the State will not comply with or implement HB2.”

The letter says HB2, which pre-empted Charlotte’s anti-discrimination ordinance, violates Title IX of the Civil Rights Act, which bars discrimination in education based on sex, and Title VII, which bars employers from discriminating.

If that determination is upheld, North Carolina could lose millions in federal school funding. During the current school year, state public schools received $861 million in federal funding.

The Republican-controlled General Assembly passed HB2 in March in reaction to Charlotte’s recent extension of its anti-discrimination ordinance, which would have allowed transgender people to use the bathroom of their gender identity. Among other things, the bill defined gender by the sex people were born with.

North Carolina is facing additional threats to its federal funding as two more agencies – the U.S. Department of Transportation and Housing and Urban Development – say they are reviewing the state’s controversial House Bill 2.

In response to questions from the Observer Thursday, a spokesperson for the U.S. Department of Transportation wrote that the agency is reviewing House Bill 2 “to determine if, among other things, it violates non-discrimination grant provisions for DOT federally-assisted projects.”

The federal DOT provides about $1 billion a year to North Carolina

HUD has also been examining House Bill 2 for more than a month. On Thursday, a spokesperson confirmed that HUD continues to review the law.

HUD provides millions in grants each year to North Carolina and its cities. In 2012, HUD Secretary Shaun Donovan announced new regulations designed to ensure that the agency’s core housing programs are open to all who are eligible, regardless of sexual orientation or gender identity.

I think a lawsuit is a constructive development; it was going to be impossible to argue McCrory & Co out of the bill; The NBA and others can now point to the outcome of the lawsuit before deciding on future business in NC. McCrory will lose: the US 4th Circuit court in VA already recently overturned a bathroom/gender bill. When McCrory loses to the DOJ in court, legal precedent will be set in NC, McCrory & Cronies will be politically castrated . . . and able to use whichever bathroom they then choose

This country is so childish. We have so many serious issues that we need to address and yet here we are fighting over where people are allowed to go to the bathroom. I tend to care less about societal norms than most so maybe I'm not the best example, but Ive just straight up walked into womens restrooms to pee because I couldn't find a mens room or it was out of service or whatever. Who cares... If some predator wanted to go into a womens restroom to assault or creep on someone then the sign above the door that specifies gender doesn't act as a magical force field to prevent them from entering or harming anyone... It is hard for me to have any reaction to this issue other than an emphatic facepalm...

I think the problem most people have seems to be the fact that the Charlotte law allows and man to go hang out in the girls locker room at a Y or gymnastics place and there is nothing anyone can do about it. I thought there was no reason for either law in the first place. I am sure I have been in the restroom with a transgender person before and did not know. If not for the law a creepy guy hanging in a locker room could be kicked out and others wouldn't have been noticed and now it is a pissing contest.

This is kind of how I feel. I didn't see much of a need for the original law (maybe I'm just ignorant of the issue), but if people had legitimate issue with some of the implications with the law as it was written then they could have started by trying to improve it to prevent some of the things they were worried about. I don't think it is a big deal to pass a pointless bathroom ordinance as long as it isn't causing any further issues, but it seems like the over the top response from most of the people opposed to it has way more to do with bigotry and homophobia than legitimate concerns about some of the implications of how the law was worded.

If something about the original ordinance actually did start to cause problems with people creeping in bathrooms or locker rooms then they could try to fix it or add some anti-creeper clause or something that makes it within the law to ask people who are actively behaving in an unacceptable way to politely to finish there business and leave. You don't have to deny anyone access or make anyone prove their gender or anything like that. If someone uses the facilities for their intended purposes and isn't actively behaving in an unacceptable manner (loitering, invading peoples personal space, making unwanted advances or using inappropriate language, etc) then there won't be any issue, but if anyone is doing any of those things then you can ask them to finish their business and stop doing whatever inappropriate thing they were doing, regardless of their gender (perceived or actual).

I feel like there has to be some kind of middle ground here, but regardless, this entire thing kind of seem like the PC police and homophobes going to war over nothing. I can see why people are picking sides at this point as I am guilty of this myself, but I find it very disheartening that it ever got to this point.
