Feeling conflicted about this one. On one hand I do believe that this is a money grab on the other hand I do believe that he raped her as I doubt she was in the right state of mind to give consent. So basically I believe that she should get nothing and Rose belongs in jail but as a Knicks fan..... :-?

Sorry about the the typo. I think he should just as a matter of strategy to show strength. And it's not without factual support. We have the ex-roomate/co-worker of the accuser.

These look bad but she's brought her character into the case by saying she's a church going girl who would never do anything promiscuous unless knocked out (meanwhile she was D. Rose's groupie but I digress). She also said that's why she doesn't want to go public - it'd destroy her reputation as a sweet girl and stress out her parents.

Just saying if she's bringing her character up to make Rose look bad he's able to bring up her promiscuity in his defense.

Unless the plaintiff has a deal with her attorneys that grants them a percentage of the settlement and exempts from legal fees if they don't get one, then she is on the hook for a big legal bill.

If Rose and his counsel are confident they will not be proven wrong I can see them holding out until this gets dismissed outright and he pays nothing other than his own legal bills.

Something like this can push it to that point of resolution now where the plaintiff may withdraw the complaint because if there is testimony that perjures her then having her identity officially revealed (even though that cat is already out of the bag) won't benefit her one bit especially when she knows she won't win.

This is what Rose needed, so I can't see it going on much longer after this evidence submission.

Agreed. Especially if there is corroboration on the events of her testimony. It pulls it out of he said/she said territory.

I wonder if Phil knew they were working on this piece of evidence when he seemed unconcerned about the case recently.

Unless her counsel feels they can impeach this witness to show bias, etc, this is pretty damning. Her side seems intent on seeing this through, perhaps they have a witness that can contradict these statements, but given that this is a strong party admission, and this witness could arguably be considered an expert witness, it's a solid day for the Rose side.

I'm pretty sure Phil believed Rose when he told him he was not guilty. Plus Noah was surely going to be highly emphatic to Phil about Rose's innocence and vouch that he knows Rose too well to think there was any lying going on. That's all I think Phil required and he trutsted they were being truthful.

I don't know that Phil would have access to Rose's counsel even if Rose agreed to it. That just may not be kosher. If he did talk to them it would probably be at most a verbal assurance they believed in their client's innocence without sharing any documentation.

And lastly, let's not forget this is an NBA party girl who got it on with JR. That sort of makes it hard to believe her from the get-go, but it also means there is probably plenty of intel within the NBA grapevine that other players could share that would get to Phil. I doubt any of Rose's fellow players would want to see him go down on false charges by a gold digger so there is probably some support for him within the community and Phil would've been informed of this.

the last sentence of doe's friend's declaration, is similar to what the accuser had said in those texts with her roommate that were later leaked by the roommate. i don't think "doe" ever thought it would get this far, maybe she felt the accusation would scare rose and prompt him to settle right away? idk, but now there's a legitimate chance she won't receive the payout she was hoping for, for that new plasma tv and couches she planned on buying with the settlement money.
