The toxicologist is saying she was wasted at midnight and sobered up at 3am. What time did the alleged rape occur?

Well you tell me. Can you be drunk at one point, and not as drunk 3 hours later? I think it's as simple as that.

exactly. toxicologist doing his best with what little he was given. all he had was doe's word to base his assertions off of.

Just stop drinking, drink water and eat food and you can sober up. Works for me all the time.

Toxicology based on interpreting text messages? I don't know. I have some folks who text me and based on that I'd could easily argue that their blood alcohol level must be in the 4's...that or they were taught the English language by someone with a BAL over 4. :lol:
