not sure, I felt the other 3 point shot of Harden people are complaining about wasn't a shooting foul either. from what I understand haven't refs been trying to eliminate the swing though shooting fouls, the running/stopping using a screen into a shooting motion so the defender bumps into you from behind, and the shooting fouls where the shooter baits/initiates the body/arm contact (the move Harden did)
