I have been wondering if Minnesota’s minimum sentencing laws would be in effect here?

Note - I've not been paying much attention to the facts of the MB case. And the facts, as you would expect, matter alot (amounts/type of drug/did you bring it into state etc). So take the following with a grain of salt. And AGAIN - this is NOT LEGAL ADVICE - IF the drug charge is 5th degree, and IF he's not had a prior 1rst or 2nd degree drug felony (which I believe is the case- he's not had one), and IF the amounts were small enough and IF there was no weapon involvement, I think the 2016 revisions suggest that he can avoid a mandatory minimum. Note this doesn't necessarily mean avoiding jail - just avoiding the mandatory sentence length. IF I recall, I think the new table suggests between a 6 month and 1 year and 1 day incarceration for 5th degree conviction + a No Prior 1st/2nd conviction (and assuming no other prior criminal history) and it would be expected that such a sentence would be stayed at the discretion of the court. But again, there are exceptions for amounts/types/concomitant conduct (i.e weapons). And I've not looked at this type of thing for a few years... So apologies if I'm off - this is from memory.

One thought - over 2/3 of the MN inmate population is there b/c of substance violations...

It was reportedly 2 pounds of marijuana so not a small amount.

I'll just say that's not optimal if it is proven to be his.

If the hate-fan-police get their way soon, we will be down Dlo/Beasley, that Jaden McDaniels kid will probably look at someone crossly and be their next on their blacklist. Just put them all in a bottle with Randy Moss and send them to an island in the pacific, right? We will wreck this season yet off your bad vibes.

This is the type of outcome I'd thought they were aiming at from a defendant perspective - namely a negotiated one as I presumed the delay suggested. It's a strong result for MB, but not surprising given his absence of prior convictions and some proof problems I could envision existing.

If he deserves time then put him away and move on ... can’t have it both ways. “I was not in my right mind” ... wow, what a good character guy leading the way for Ant

Dewey is there an official quote from Malik saying he wasn't in his right mind or you're just speculating?

Quoted straight from the Star Tribune Sports section ... no speculation.

I don't get the Star Tribune. That's why I asked. So he wasn't in his right mind. Why not?

I think you guys are reading into this quote a little too much. At the end of the day he is man trying to avoid going to prison surely his lawyer told him to say those exact words.

Another Timberwolves thing to do. Let's overapaid a player that pleads guilty and better yet, let's starting him. JUST GREAT
About the overpaid part... He can definitely one day be worthy of the contract he got or not. But the fact is that when he got the contract (1 month ago or so) he was OVERPAID.

That's a lot of probation. Does he have to spend any time in jail, house arrest, community service? Is there a civil suit and financial compensation to the threatened family? Lot of questions.

If a person says they're not in their right mind you'd think there would be a reason for it.

Timberwolves guard Malik Beasley and the Hennepin County Attorney's Office reached an agreement Monday that Beasley will serve 120 days in the workhouse in exchange for him pleading guilty to a threats of violence count while having a felony drug charge dismissed.

Both charges are related to a September incident in which Beasley is alleged to have aimed a rifle at a couple and their teenage daughterin an SUV outside his Plymouth home, where a large stash of marijuana and other guns were seized by police.

Beasley appeared by video remote for Monday's plea hearing and said, "I've learned my lesson" while answering questions from his attorney.

"I could have retreated," he said. "I was not in my right mind. I'm ready to move on."

Formal sentencing is scheduled for Feb. 9, when Judge Hilary Caligiuri will most likely accept the terms of Beasley's guilty plea, which also includes being on probation for three years.

If Beasley successfully completes his probation, the felony will be reduced to a misdemeanor on his record. However, if he violates any of the terms, he could face a harsher punishment.

Only after sentencing will a date be set for when he would potentially have to report to the workhouse. The Athletic reported that Beasley's attorneys, Steven Haney and Ryan Pacyga, said any time served would come after the end of the 2020-21 season, which is set to open Wednesday for the Wolves.

Beasley might be allowed to serve his time on electronic home monitoring as part of the judicial system's efforts to prevent the spread of the coronavirus in lockup facilities.

Pacyga was not immediately available to answer questions Monday afternoon about the plea deal.

A felony drug charge remains against his wife, 23-year-old Montana Yao — who has reportedly filed for divorce from Beasley.

What does, “I could have retreated” mean?

I don’t view staying in his home, and NOT going out to the street to point the rifle at that family as “retreating?”

Why is he saying that now, when he IS in his right mind? If a lawyer really is scripting his words, that seems like a very odd word.

I took it to mean retreating as in not manning up and taking responsibility.

I hope so, but he immediately followed it with, “I wasn’t in my right mind,” which would be a quick jump back to the event.

I’m going to stick with your interpretation, because I like it better.

Yeah, that’s odd language. Almost implies he felt he was in danger and need to defense himself (self defense). Maybe that’s not being in his right mind, as by all accounts this was a fam with kids on a public street/sidewalk.

Hopefully he fulfills all aspects of probation. I don’t know what conditions they have in MN, but in FL, where I practice, generally no alcohol/drugs and include random testing. You violate, a judge can essentially sentence you up to the max for the charge.

Now that the Magic have re-signed Isaac, I feel like there is a wink-wink deal centered around Beasley for Gordon come March 3. Makes too much sense not to happen.
