A federal judge has ordered the release of a key Justice Department memo supporting former Attorney William Barr’s conclusion that former President Donald Trump should not be prosecuted for obstruction of justice over episodes investigated by special counsel Robert Mueller.

U.S. District Court Judge Amy Berman Jackson issued that ruling in a withering opinion that accused Barr of being “disingenuous” when describing Mueller’s findings and found that the Justice Department was not candid with the court about the purpose and role of the 2019 memo prepared by Justice’s Office of Legal Counsel.


“Not only was the Attorney General being disingenuous then, but DOJ has been disingenuous to this Court with respect to the existence of a decision-making process that should be shielded by the deliberative process privilege," she wrote. "The agency’s redactions and incomplete explanations obfuscate the true purpose of the memorandum, and the excised portions belie the notion that it fell to the Attorney General to make a prosecution decision or that any such decision was on the table at any time.”


I can't help but think Garland's DoJ is not going to fight this ruling.

I wonder what the Statute of limitations is on obstruction of justice.

Collusion may be a hoax in the sense that they weren't guilty of it but only
in the (narrow technical) sense that it's not an actual crime. But conspiracy and lying to investigators
is. Manafort and Stone weren't convicted for nothing.

Five years in Federal court.

There is no statue of limitations on Treason though.

Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.


To render assistance or counsel. Any act that deliberately strengthens or tends to strengthen enemies of the United States, or that weakens or tends to weaken the power of the United States to resist and attack such enemies is characterized as aid and comfort.


Considering cyber attacks on the US by Russia, they have absolutely proven themselves our enemy. And no doubt the Trump cohort gave them 'aid and comfort' in various ways. Within the United States and elsewhere. If conversations with Putin were to come out, and after Trump's taxes come to light, I have no doubt we would see indictable offenses in this vein.

I’m not a historian but there isn’t any proposed legislation that
was awful and that the filibuster saved us from. That I’m aware
of. The filibuster is more generally been used to stop or delay
important advances.

“I would just say to my Republican colleagues: Can we move forward without President Trump? The answer is no,” Senator Lindsey Graham said in an interview on Fox News this week. “I’ve determined we can’t grow without him.”

And this - as much as anything else - is why there' never in the foreseeable future a reason for Dems to compromise with Reps in Congress. There's no point to it. because Republican "leaders" have zero character and are fine shooting for the lowest common denominator as long as they think that gives them the best chance of personal success. All you have to do is look at what Graham said about Trump during the 2016 primaries. And his words were much harsher than mine. He's the one who told everyone to use his words against him, and that will be how the world ultimately judges him - the most 2-faced politician we've ever seen.

The optimist in me believes that this infatuation with such a truly horrible
and tragically damaged person as leader is doomed to end badly.
The concern remains about how much damage to all of us this will result
in. And as hard as many of us try to convince these followers that this
is not going to end well, the saying there are none so blind as those
who will not see comes to mind.
