It would trigger the hard cap at the first apron because the TPE was generated last season.
If they resign Precious first they could go over the 1st apron in using the TPE but then be hard capped at the 2nd apron after using it I think.
Using a TPE generated last season or using part of the non taxpayer MLE would trigger a first apron hard cap. Taking back more money than sending out in a trade or receiving a player via sign and trade triggers hard cap at 1st apron.
A second apron hard cap was generated by aggregating salaries. I also believe sending an outgoing sign and trade player (Milton) also triggers the 2nd apron hard cap.
Remember - this system was designed to level the playing field for big market teams who could eat the tax and small market teams that can’t (and save low income owners like the Kronkes and Balmers money)
