From my understanding this along with every other helicopter is flown only with visual rules due to too much cost , too much training and very rare occurence of such a fog to fly by instrument rules. Once again, only Kobe could have aborted the flight especially when they started circling but once they got into a big fog the pilot seemed to have lost his balance and it was a death spiral more or less.

The circling didn't have anything to do with IFR/VFR. they were waiting for a plane to clear the space. the visibility was fine after that.
this accident had 0 to do with the circling over Glendale. At Van Nuys they were not in SVFR anymore, they were completely VFR.
Passangers most likely were not aware of what was going on(which makes it easier for us to deal with this).
The pilot was reckless and overconfident when he didn't declare emergency when he went into the clouds, and he was going 150mph.
Helicopters can stop in the air unlike airplanes. He could have done that and declare emergency, and the ATC would help him from there.
He had a previous incident regarding weather related conditions.
PS: Pilots are responsible for the flight. They can cancel the flight if they want to, and the passengers cannot do anything about it.
