Mavs and Dalmebert/ Waived and traded players and CBA

Much confusion on mavs board on how they can get dalembert. They traded him in the last NBA year (June 25, 2014). If they wished to re-acquire, can they trade for him? Can they get him off of waivers if/when he is waived by NYK?

Because the Dalembert trade happened in the last league year, the Mavs could re-acquire him. They can't claim him, as they don't have any space or exceptions to do so. Now that he has been waived, he can't be traded. So, the only way Dallas is getting him is by signing him to a pro-rated veteran minimum deal for the remainder of this year. They don't have any other exceptions available to them to do that.

That is not accurate info. The Mavs could NOT sign Dalembert if he is waived. The limitation is "one year or end of season in which the contract ends" so there's no way the Mavs are eligible to sign him.

From the CBA the quote is:

•A team cannot reacquire a player they traded away during that season (a season being July 1 - June 30). If he is waived by his new team, then he cannot re-sign with his original team until the one-year anniversary of the trade, or until the July 1 following the end of his contract, whichever comes first. However, if a team trades a player's draft rights, they can reacquire the player during the same season.


I read that as traded away during "that" season being last season. But now that I re-read it, I think you are correct. I got tripped up on the that season being last year and the July 1st. But I wasn't thinking of it being this coming July 1st because of when he was waived.

Mavs ability to sign Dalembert, if he is waived, is whichever is first between

June 25, 2015 - one year anniv of trade, or
July 1, 2015 - next season after end of contract

In either event, that's after the end of the season and results in waiting until July 2015 free agency if he's available then. The only way the Mavs would have been able to get him would have been via trade, or if he was traded to a different team (say, Philly) who then waived him. At this point, those options are obviously moot.
