I mean...how long was this stop for traffic? Was it hours? Minutes? I 100% have been tired enough where I've pulled over to sleep, alcohol free. Now the fact horns likely blasting at him didn't lead him to waking up before officers showed up tells me he wasn't sober. But imagine if he just started drinking because he'd been there a few hours?
Obviously he as not fully sober, my point was if he fell asleep while driving it could have done way more damage.
That generally isn't going to happen. But yes that'd be awful.
I'm not sure it's clear what happened. If an officer was right by him and saw him sleeping before horns. Then very well maybe he wasn't drunk. We don't have the details. A lot of lawyers tell people to skip all tests so it's not crazy Pierce just defaulted to that. IMO no reason not to take a breath test if you're sober...but even if you had 1 drink HOURS ago, many might not risk it. Don't get me wrong, I'm 100% assuming he was drunk, but we certainly don't know for sure.
Never forget, this below actually happened...you can find the full video but this is a short enough one if you didn't see it before. These things happen and they're WILD! And this kid's example if 100% why it's just dumb to deal with some officers.
