This leaves Rubio with his current option, which I believe is his best course --- State his intention to play out his contract and in the meantime continue to seek a declaratory judgment on the buy out provision. Worst case scenario -- the buyout provision is upheld and he can try to renegotiate after he plays another year there. If DKV again refuses to negotiate, he'll play two years.

According to El periodico though Rubio has to drop the lawsuit. So it looks like he is going to play out his contract hoping they reduce their buyout. If they do not though in 2 years Rubio could decide to stay in Europe like Fran Vasquez.

If Rubio continues to develop a Euro team could decide to give him a lot more money in 2 years than an NBA rookie contract.

Why do you say he has to drop his lawsuit? I thought DKV's stance was that he had to drop the lawsuit in order to negotiate, not to play. (they can't just not play him -- that would open up a whole new batch of legal worms, i.e. retaliation) If that's the case, Rubio should call their bluff and act like he's going to play. Then wait for the court decision.

Fran will not come over because he is bound to sign a contract that is far less than what he is currently making in Europe. So he likely will never come over. This is the reason why pekovic was the 1st pick in the 2nd rd so he would not be bound to the rookie scale. Rubio gets very good pay if we compare salary in the NBA vs Europe, but it is this buy out amount that hurts him.

Very different situation.

Sure. Then don't declare for the draft unless you are willing and able to play once the season starts.

You're right he might be dropping it not because he has to but he is dropping the lawsuit according to yahoo. So whether its in order to negotiate or just to call their bluff the point is that he cant wait on the courts to see if his buyout is illegal. So we can't rely on the litigation process to dictate what's going to happen. Its up to DKV now and we can only guess if they reduce his buyout or give him a large contract in 2 years. The publicity will surely help their ticket sales.

Yahoo is quoting the El Periodico report --- my spanishi s dicey at best, but I thought it said that Rubio is meeting with lawyers to decide if she should drop the lawsuit -- not that he definitely is going ot drop the lawsuit. We'll jsut have to wait and see. If he drops the lawsuit maybe they'll reach a buyout.

Now I'm not a smart man...

But if the Sports Illustrated report is anywhere near correct, which I doubt, and RUbio wants Flynn gone, doesn't that mean Rubio actually wants to play for Minnesota? Just not with Flynn? It's stupid for him to say that, but that means New York fans can suck a popsicle.

http://www.ballineurope.com/european-ba ... in-europe/

This site lists the team budgets (not salary, entire operating budget) of euroleague teams from last year, in US dollars. Take those numbers and multiply them by 50-60 % and that is what they have to spend on player salary.

Rubio's team, DKV Joventut (Listed as "Badalona"), is listed at 12.48 million. That means they have 6-7 million to spend on players each year. Rubio's buyout was 6.6 million, now technically nearly 8 million until june. And you don't think they want that money pretty badly?

I haven't seen exactly how much they owe the spanish IRS or how close to going broke they are, but I do know the global recession is hitting most of europe far worse than it's hitting the US.

Maybe they can't afford to reduce the buyout to 3-3.5 million, what it would take to make it economical for ricky. But they certainly can't afford to receive nothing from him this year, plus pay him 100k. Perhaps they had a buyout arranged pre-draft under the assumption ricky went 2nd, and now they are balking at having to re-negotiate it.

There's another very important question, how much does Joventut gain in marketing by having Rubio? I really can't make a good guess here as I don't really know marketing/endorsement situation in Spain.

Nice post a while back Dr. Krapinski..I had the same view as you but you put it into a more "legal" and organized post. Really this is EXACTLY what I'd do if I really wanted to play in the NBA next season....or go back to spain lol. All of his quotes saying he's so excited to be in the NBA and it's been a life-long dream, etc. etc. makes me think there's no way he actually "wants" to go back. It's all been about his chess-match of a buyout. I think he's going about it the right way and hope he can force DKV Joventut's hand to lower the buyout therefore scoring us a Rubio!!!!

Well if their entire operating budget is 12.5 million and the team is still losing money, whatever it is, it can't be that significant.

I think we tried that once with Joe Smith... it didn't work out so well.

Then your team should have traded with Washington instead of rejecting the deal it's to damn bad he's not a free agent.
