This leaves Rubio with his current option, which I believe is his best course --- State his intention to play out his contract and in the meantime continue to seek a declaratory judgment on the buy out provision. Worst case scenario -- the buyout provision is upheld and he can try to renegotiate after he plays another year there. If DKV again refuses to negotiate, he'll play two years.
According to El periodico though Rubio has to drop the lawsuit. So it looks like he is going to play out his contract hoping they reduce their buyout. If they do not though in 2 years Rubio could decide to stay in Europe like Fran Vasquez.
If Rubio continues to develop a Euro team could decide to give him a lot more money in 2 years than an NBA rookie contract.
Why do you say he has to drop his lawsuit? I thought DKV's stance was that he had to drop the lawsuit in order to negotiate, not to play. (they can't just not play him -- that would open up a whole new batch of legal worms, i.e. retaliation) If that's the case, Rubio should call their bluff and act like he's going to play. Then wait for the court decision.
