Yes you can. Labor laws really don't offer much protection to people who refuse to work based on mental health issues not signed off on by a licensed practitioner (which seems to be the case with Ben Simmons), and employers around the country are mandating vaccinations. In both situations, if you are not available for work, you can and will get fired. My company here in NJ just announced that they are moving towards that step next to protect the workers and our families (and their bottom line, of course). We've had this discussion before, you seem to think that the USA is some Libertarian free for all when it is not and never has been.
Simmons didnt get it checked by team doctors which was the big issue. either way, they cant make him play. they can fine him, which they are. this isnt some dictatorship where humans are slaves and have to go to work with no free will. doc pay if its not medically protected or fire them
Regarding the CBA, imo the owners are going to want the option of getting out of having to pay these guys for this kind of stuff. Joe Tsai and Josh Harris are shelling out millions right now for two max players who aren't playing not due to injury. They're going to get the players locked out.
Neither simmons or kyrie are getting paid for games they miss on their own accord. this protection already exsists.
Regarding Simmons, his situation is suspect because while he wanted a trade, he only showed up to Sixers camp to get paid and when he got there he got thrown out of practice for being an ass hole. Then all of a sudden mental health was thrown out there as to why he didn't want to report. I do think that Ben does have some mental health issues in terms of his court play, but we all know that he's done with Philly after getting thrown under the bus following their playoff loss and wants out. Which is fine, but I doubt owners are going to want a repeat of this situation again where a guy is holding out and getting paid.
The owners will always see repeates. mental health issues are real. they cant police it away, and when you force mentally ill people to work or try and force them to live normal life, bad things happen (like the malice in the palace)
Regarding Kyrie, vaccine mandates, private or public, have been apart of American life dating back to the 1700s. All that stuff about the constitution, geneva convention etc is nonsense. Every American starts out their early life having to get vaccinated to attend school, private or public. This isn't anything new nor is it some violation of the law, civil rights, or international law like you are falsely implying.
it is if you want to start forcing them to take it. if they are willing to accept the lack of mobility and opportunity or lose wealth because of it, that should be the sacrafice. you can t start making people put stuff in their body they dont want to.
ESPECIALLY when the mandate is politically motivated and spits in the face of science
